    The Minutes of the meeting of the Committee held on 21 September 2017, copies of which had been previously circulated, were agreed by the Committee and signed by the Chairman as a correct record.

    A statement was read at the meeting from Councillor J Cook, concerned about the loss of a community asset and the cramped scale and design of the proposal.

     

    It was reported at the meeting that the floorspace calculation on page 5 was incorrect and so the increase in floorspace on the site was approximately one third.

     

    Having carefully considered the officer’s report and representations made at the meeting, the Committee did not consider the loss of a restaurant use on this particular site would be detrimental and were satisfied that the proposed design of the development met the relevant design standards.

     

    Accordingly, it was resolved to grant:

     

    Conditional Permission with conditions delegated to the Head of Sustainable Development but to include the removal of Permitted Development rights in respect of extensions/alterations and the conversion of garage spaces.

    A statement was read out at the meeting from Councillor J Cook expressing concern about the loss of business premises and  detriment to the street scene.

     

    Two late submissions had been received.  Amersham Residents Association generally supported redevelopment of the site but objected to the proposed height of the building,, would prefer 2 storey and were concerned about loss of privacy to neighbours.

     

    Environmental Health had no objection in respect of contamination issues subject to imposition of an appropriate condition.

    RESOLVED -

             

    Follow up action was authorised in accordance with Central Government Guidance in para 207 of the National Planning Policy Framework (NPPF) and Chiltern District Council's Planning Enforcement Policy and the Planning Committee authorised the service of such Enforcement Notices, including Stop Notices in respect of the development as described above as may be considered appropriate by the Head of Sustainable Development and the Head of Legal and Democratic Services.  The precise steps to be taken, period of compliance and the reasons for serving the notice to be delegated to the Head of Sustainable Development.  In the event of non-compliance with the Notice, the Head of Sustainable Development having delegated authority to instigate legal proceedings in consultation with the Head of Legal and Democratic Services and/or direct action to secure compliance with the Notice.
