    The Minutes of the meeting of the Committee held on 1 June 2017, copies of which had been previously circulated, were agreed by the Committee and signed by the Chairman as a correct record.

    Minutes:

    Councillor J E MacBean declared a personal interest in planning application CH/2016/1770/FA.  Nature of interest – Councillor MacBean was a Member of Chesham Town Council.

     

    Councillor C M Jones declared a personal interest in planning application CH/2016/2081/RC.  Nature of interest – Councillor Jones knew some of the objectors.

    It was reported at the meeting that the final sentence in condition 2 on page 14 be deleted.  It was reported that a revised wording of condition No.13 would be appropriate, making specific reference to fascia panels and grid/lattice metalwork.

    The following matters were reported at the meeting:-

    ·           that Chesham Town Council had indicated that they would accept a Section 106 contribution towards enhancements at Co-Op field;

    ·           corrections to the block numbers included in paragraphs 27 and 47 and reference to Fair Lees in paragraph 47;

    ·           an additional letter of objections had been received but it did not raise any matters not already covered in the Officer’s report;

    ·           supplemental information from the applicant about housing need and supply in the District had been circulated to all members of the committee;

    ·           2 additional informatives were proposed concerning fire safety measures and  for the schedule of materials submitted under condition 7 to reflect material shown on the application plans

     

    Councillor A Bacon addressed the meeting as the local member for Asheridge Vale & Lowndes.

     

    Minded to grant conditional permission, with the decision deferred for the prior completion of a Section 106 Planning Obligation dealing with provision of affordable housing; delivery of business space and protection of the specific uses proposed; delivery of open space and footpaths, together with their future access by the public; a  financial contribution to enhancements at Co-Op Field; a sustainable transport contribution towards improvements in public transport infrastructure; payment of Travel Plan monitoring fee; an education contribution; a whole life maintenance scheme of sustainable drainage and a Section 278 highways agreement dealing with off-site highway works.  Final decision, including final conditions, delegated to the Head of Sustainable Development subject to the prior completion of a Section 106 Planning Obligation and Section 278 Agreement.  Any negotiation or changes to the Legal Agreement to be delegated to the Head of Sustainable Development with authorisation to refuse planning permission if an acceptable Legal Agreement is not completed, in consultation with the Chairman of the Planning Committee. 

    Additional informatives were added relating to fire safety measures and materials to reflect those shown on application plans.

    It was reported at the meeting that amended plans had been received that would reduce the chimney size by 0.3 metres such that it would fall within normal “permitted development” limitations.

     

    Defer – minded to approve the plans as amended and decision delegated to the Head of Sustainable Development subject to the expiry of the advertisement period and no new points of objection being raised.  Conditions to include a requirement for the works to  the reduction in the height of the chimney be carried out within 2 months and in matching materials.  In the event that works are not undertaken, further action was authorised, see Minute 19 below.

In the event of non-compliance with the Notice, the Head of Sustainable Development having delegated authority to instigate legal proceedings in consultation with the Head of Legal and Democratic Services and/or direct action to secure compliance with the Notice.
